Heard.

The applicant, who is barely 18 years old and a student is apprehending arrest in Crime 23 of 2018 for offence punishable under section 65(E) and 83 of the Maharashtra Prohibition Act.

Concededly, this is the first offence under the said Act for which the applicant is implicated. The material which is brought to my notice is that a co-accused has named the applicant. Other than the statement of the coaccused, there is no material on record to connect the applicant with the crime.

In the light of the accusations, and the material on record, and in view of the fact that the applicant is a student with no criminal antecedents, I am inclined to allow the application. The interim order dated 18.5.2018 is confirmed.

The applicant to abide by the conditions of the interim order with modification that the attendance at
