Heard Shri A.R. Wagh, learned Counsel for the petitioner and Ms. N.P. Mehta, learned A.G.P. for respondents.

Learned A.G.P. is seeking time of two weeks to file reply. Request is being strongly opposed by learned counsel for the petitioner. He submits that Tractor of petitioner has been high handedly detained without producing any report of the competent Authority.

We do not wish to go into the merits of the controversy as reply is not yet filed. We grant leave to petitioner to deposit the amount of fine/penalty, as

Order 1109wp4181.17 directed by the Authority without prejudice to his contention. If such amount is deposited within a period of one week from today, respondent no.2 shall forthwith release the tractor of petitioner, after obtaining undertaking from him that if it is required to be produced for legal proceedings again, he shall make the same available.

We also grant leave to petitioner to raise all grievance by preferring a representation before the Collector, Gadchiroli. If such representation is moved within a period of two weeks after release of the Tractor, the Collector, Gadchiroli shall look into the said representation within next four weeks.

Keeping all rival contentions of petitioner open, with above directions, we dispose of the present Writ Petition. No costs.
