Heard.

The learned counsel for the respondent states that the entire arrears are transferred in the bank account of the petitioner - 1. The learned counsel for the petitioner - 1 does not dispute the statement.

The learned counsel for the respondent Smt. Dharmadhikari further states that the respondent has instructed his banker to transfer Rs. 20,000/- to the bank account of the petitioner - 1 out of which Rs. 10,000/- is towards payment of arrears. Now, that the entire arrears are paid, the amount of Rs. 10,000/- which was towards payment of arrears should be re-transferred by the petitioner to the account of the respondent, in the event the

wp458of16.odt 2 respondent is not in a position to modify or revoke the instructions. The learned counsel for the petitioners Smt. Anjankar undertakes to re-transfer the extra amount, if received. In view of the payment of arrears, the learned counsel for the petitioners seeks liberty to withdraw the petition.

Needless to say, the payment is made by the respondent without prejudice to his right to challenge the substantive orders.

Petition is disposed of as withdrawn.
