It is submitted that the Aurangabad Bench of this Court in Writ Petition No. 6143/2023 and connected petitions has already decided the issue on 19/03/2024, holding against the petitioners. However, it is stated that because of challenge
(2) 917 wp 3577-2023 and ors to the vires of the Maharashtra Judicial Services Rules, 2008, which is pending before the Principal Seat, applications have been moved to the Hon'ble Chief Justice for taking up all these matters. Considering which, it would be appropriate, to wait for sometime to ascertain the position regarding clubbing. WRIT PETITION NO. 3577 OF 2023 A statement is made by Mr. Kalwaghe, learned Counsel for respondent No.3, the petitioner has failed to clear the prelims examination. The position is not disputed by Mr. Ghatte, learned Counsel for petitioner, on account of this, the petition is rendered infructuous as per the statement of Mr. Ghatte, learned Counsel for the petitioner, accepting which, the petition is dismissed as infructuous.
WRIT PETITION NO. 3569 OF 2023 Mr. Tirukh, learned Counsel for petitioner, upon instructions, submits that petitioner Nos. 2, 4, 5, 6, 7 and 12 have failed to clear the prelims exam and therefore, the petition in so far as these petitioners are concerned has been rendered infructuous.
