It is the case of the applicant-wife that the nonapplicant-husband is not regularly paying the interim maintenance and, hence, the appeal should be dismissed. The appeal cannot be dismissed on the aforesaid ground. The applicant may file appropriate proceedings before the Executing Court, if the non-applicant is not paying regular maintenance to the applicant. Also, this fact could be pointed out to the Court at the time of final hearing of the appeal. The civil application stands rejected.

C.A.O. NO.1403/2016.

By this civil application, the applicant seeks a direction against the non-applicant to rectify the errors in the paper book.

Shri Aurangabadkar, the learned counsel for the non-applicant, states that the necessary amendment would be carried out in the paper book, if so required. It is stated that the errors, if any, would be corrected within three weeks. We grant leave to the non-applicant to correct the errors and/or replace the pages of the paper book in which, there are errors. The amendment should be carried out within three weeks.

The civil application stands disposed of accordingly. JUDGE JUDGE APTE
