Heard Shri S.S. Dhengale, learned counsel for the petitioner.

By this present application the applicant is challenging the First Information Report dated 15.07.2021 registered with police station Borakhedi, Dist. Buldhana for the offence punishable under Sections 7 and 7(A) of Prevention of Corruption Act, 1988.

The applicant is the Agricultural Officer of panchayat Samiti Motala. The report is given by the nonapplicant No.2. 4.
After perusal of the First Information Report and after hearing the learned counsel for the applicant when the Court was about to dismiss the application, Shri S.S. Dhengale, learned counsel for the applicant would submit that the applicant wishes to withdraw the present application. Further, from the perusal of the First Information Report, at this stage,
13 apl 871.2021 the learned counsel for the applicant submits that he will prefer an application for discharge.

After perusing the First Information Report, we are of the view that such a prayer cannot be granted since, the statements of fact as recorded in First Information Report clearly show that this is a fit case for trial. 6.
The criminal application is dismissed as withdrawn. 7.
Since, the learned counsel for the applicant is withdrawing this application, the Court is not giving detailed reasons as to why this application needs dismissal. JUDGE JUDGE C.L.Dhakate
