DATED : 25 th JANUARY, 2016 The order dated 20.10.2015 was passed after hearing respective counsel for the parties and in that view of the matter we do not find that there is any need for modification of the order dated18.6.2014. However, we clarify that the pensionary benefits and the pension paid to the petitioner shall be paid and drawn on the basis of actual salary paid to him on the date of his retirement. The civil application is accordingly disposed of. CAW 1630/2014.

For the reasons stated, the civil application is allowed. The filing of English translation is dispensed with subject to condition that the counsel for the applicant shall file an undertaking that as and when directed by this court, the applicant shall furnish the translations.
