Adv. Bandre is relying upon the view of Division Bench of this Court taken at Aurangabad in Writ Petition No.9467/2014 and other connected matters on 11/12/2014 to urge that as lease period of petitioner did not fall short and his application was in accordance with stipulation to that effect contained in advertisement, the petitioner needs to be issued a letter of intent.
Adv. Meghe for respondents points out that the petitioners before this Court at Aurangabad had approached Hon'ble Apex Court in special leave petition. Similarly, Oil Companies aggrieved by
1104wp3775.15 2/2 adjudication at Nagpur in Writ Petition No.2812/2014 and other connected matters on 9/10/2014, had also approached Hon'ble Apex Court. The Hon'ble Apex Court has in view of policy decision of Ministry dated 21/1/2015 disposed of special leave petitions and Oil Companies are permitted to implement that policy decision. He makes a statement that accordingly entitlement of petitioner along with others (if any), who may become eligible for consideration because of said policy decision, shall be examined afresh.
In view of these developments, it is apparent that support being taken by petitioner from judgment delivered at Aurangabad cannot now be looked into.
Hence, in view of statement made by Adv. Meghe, we dispose of the petition as infructuous. No costs.
