DATED : 08 - 0 6 -201 The accusation against the present applicant is that he alongwith others induced financial institutions to advance loans by creating fabricated and fraudulent documents.

When the application was listed on 22-5-2018, the learned Counsel for the applicant, on instructions, submitted that the applicant has deposited an amount of Rs.80,000/- with Bank of India and is willing to deposit the balance amount into installments. The first installment of 50% of the balance amount was undertaken to be deposited within eight days. The interim protection was extended accepting the said statement.

The learned Counsel for the applicant, in all fairness, states that the applicant has not complied with the undertaking extended to this Court. That apart, even
2 aba359.18 otherwise on perusal of the affidavit-in-reply of the State, prima facie the offence is serious and it would be necessary for the investigating agency to interrogate the accused in custody.

The application is rejected.
