After hearing the matter for some time, the learned Counsel for the applicant states that the applicant is willing to surrender himself to the custody of the concerned Sessions Court/Special Court, if the applicant is granted interim protection till the time he does so.

The learned A.P.P. has taken an exception to this proposal.

Considering the fact that the applicant is now desirous of showing his bona fides in the matter, there being an allegation that he is absconding, and surrender himself to the law and also the fact that this Court has granted interim protection on 17th June, 2016, it would be appropriate that the same protection is extended to him to enable him to surrender himself to the custody of the concerned Sessions Court. Thereafter, the applicant may invoke the jurisdiction of that

aba.386.16 2/2 Court under Section 439 of the Code of Criminal Procedure regarding grant of regular bail or otherwise. In view of above, the application deserves to be disposed of in the following terms :

1. The interim protection granted by this Court as per the order dated 17/06/2016 is hereby extended till 15/07/2016 or till the date on which the applicant surrenders himself to the custody of the concerned Sessions Court/Special Court, whichever is earlier and on his surrendering before the concerned Sessions Court/Special Court having jurisdiction in the case, the Sessions Court shall pass appropriate orders in accordance with the law.

2. Liberty to apply for grant of regular bail is granted. If such application is filed, the same shall be decided in accordance with law.

3. The application is disposed of in above terms. JUDGE *sdw
