On hearing the learned counsel for the parties for some time, we find that certain relevant submissions made on behalf of the petitioner do not find place either in the original petition or in the amended petition.

The learned counsel for the petitioner seeks permission in the aforesaid background to withdraw the writ petition with liberty to file a fresh petition. Since on a perusal of the document at Page No.105, it prima-facie appears to us that the petitioner was appointed earlier than the appointment of two other Assistant Teachers, who had been granted approval by the respondent no.2-Education Officer, and since this relevant aspect does not find place in the grounds raised in the petition, we permit the petitioner to withdraw the writ petition with liberty to file a fresh petition. The learned counsel for the petitioner states that a fresh petition would be filed within a period of two weeks. In view of the aforesaid, on the prayer made on behalf of the petitioner, we continue the interim relief for a period of two weeks only.

WP3005-14 The writ petition is disposed of as withdrawn with liberty, as aforesaid.
