The appeal is against conviction of the appellant under Section 307 of the Indian Penal Code, where under he has been sentenced to suffer rigorous imprisonment for a period of five years and fine of Rs.1000/- by the learned Trial Court, which sentence has been suspended and the appellant was enlarged on bail by this Court by an order dated on 09.08.2007, however, considering the fact, that the appellant is no more, the appeal is rendered infructuous, as the record does not indicate that the fine has been paid.
