The contentions are the One Time Settlement (OTS) proposal was approved but on the very same day a symbolic possession of the petitioner's property who was guarantor was taken. It is claimed that the petitioner so as to show bonafides is willing to deposit the entire amount based on OTS proposal.

The learned counsel for the petitioner submits that the petitioner has approached the Debt Recovery Tribunal with a prayer for not to confirm the order of possession on 21/03/2024. However, the said proceedings are not decided till this date.

In view of aforesaid factual background, we deem it appropriate to direct the petitioner to appear before the Debt Recovery Tribunal on or before 24/06/2024 with appropriate request. 5.

We direct the Debt Recovery Tribunal to consider and deal with the petitioner's request expeditiously and in any case before the petitioner loses physical possession of her property. 6.
