DATE : AUGUST 05, 2015 The order under challenge dated 21/04/2014 is passed on an application seeking condonation of delay in filing proceedings under Order-41 Rule-21 of the Code of Civil Procedure. Against an order refusing the application under provisions of Order-41 Rule-21 an appeal has been provided under provisions of Order-43(1)(t) of the Code of Civil Procedure. Hence the writ petition is permitted to be withdrawn with liberty to file appropriate proceedings in accordance with law. The points raised in the writ petition are kept open.
