The applicant is apprehending arrest in Crime 142/2018 registered at Dharni Police Station for offence punishable under section 354-A(D) of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012.
The accusation against the present applicant by the victim, who is 15 years is that the applicant attempted to outrage her modesty by putting his hand on her shoulder, at 08:00 p.m. or thereabout on 16.04.2018. The accusation is also that the applicant used to stalk the victim. The apprehension of the prosecution is that if anticipatory bail is granted the safety of the victim shall be in jeopardy. The apprehension can be taken care of by directing that the applicant shall not enter the territorial jurisdiction of Dharni initially till the charge-sheet is filed. After the charge-sheet is filed, it shall be open for the applicant to seek a modification of the conditions
aba366.18.O.odt 2 imposed and depending upon the circumstance then obtaining, the request shall be considered on merits. The applicant shall not tamper with the evidence nor shall the applicant directly or indirectly attempt to influence the witnesses in any manner.
The applicant shall furnish his current address and mobile number, if any, to the I.O.
