The Petitioner, voter from Ward No.13 in the Municipal Council at Wani, Dist. Yavatmal has filed this Petition making a grievance that the Respondent No.1 - Collector is not taking cognizance of the complaint made by the Petitioner regarding encroachment by an elected member of the Wani Municipal Council.

While there is no special locus in the Petitioner, nor the Petition can be converted as a lis between the Petitioner and the Collector, considering the fact that a voter has made a complaint to the Collector in respect of an elected representative, the Collector will look into the complaint and take it to its logical end after following the due procedure on its own merits, at the earliest.

Writ Petition is accordingly disposed of.
