Heard.

The applicant is apprehending arrest in Crime 104 of 2017 registered with the Police Station Kamptee, Nagpur for offence punishable under section 420, 468 read with section 34 of the Indian Penal Code.

The accusation is one Ritesh Kanojiya lodged the complaint on 31.12.2017 alleging that he was induced to part with an amount of Rs. 6,50,000/- on the false promise that he would be provided with job. The applicant is not named in the First Information Report.

Perusal of the material on record would reveal that except the statement of the co-accused, there is no material on record to connect the applicant with the crime. The observation of the learned Sessions Judge that applicant made a farce of conducting medical examination is not supported by material on record. In this view of the matter the application shall have to be allowed.

In the event of arrest in Crime 104 of 2017, the

aba368of18.odt 2 applicant shall be released on furnishing personal bond of Rs. 15,000/- with a solvent surety of like amount. The applicant shall attend Police Station Kamptee as and when called upon to do so by the Investigating Officer.

The applicant to furnish his current address and mobile number to the Investigating Officer.

The applicant shall not tamper with the evidence nor shall he attempt to influence the witnesses in any manner.
