Heard Ms. A.D. Warjurkar, learned Counsel for the petitioner and Ms. H.N. Prabhu, learned A.G.P. for respondents.

It is not in dispute that the matter can be disposed of in terms of the judgment dated 09.07.2018 passed in Writ Petition No. 7295/2017 and other connected matters.

In view of this, for reasons recorded in that judgment, we quash and set aside the show cause notice dated 22.03.2018.

We direct petitioner to appear before

respondent no.2 Collector on 10.08.2018. The Collector, shall then proceed further and give him a suitable date for appearance and an opportunity of being heard. The material on record to be used against the petitioner shall be looked into by parties and after giving petitioner necessary opportunity, final orders shall be passed within a period of next eight weeks.

It is made clear that the petitioner can move an application before the said Authority for issuance of royalty passes and the Collector, shall take a suitable decision on such application, within a period of period of two weeks after it is filed.

If application for renewal of Mining Lease made by the petitioner is pending, in view of above developments, the Collector is free to pass fresh orders on it, as per law within a period of four weeks. 7.

With these directions, we partly allow the Writ Petition and dispose of the same. No costs. JUDGE JUDGE Rgd.
