Heard the learned Counsel for the applicant and the learned A.G.P., who has appeared by waiving notice on behalf of the State.
The ground taken in this application is that the applicant has been advised by the Medical OfÏcer of Sub-District Hospital, Achalpur, District Amravati rest for 90 days. A copy of Certificate [Annexure-B] is enclosed in support of the ground so taken. There are two words in this Certificate which are not legible. The third expression "non-progression of labour" is what is discernible from this Certificate. The expression "nonprogression of labour" has been used in the context of this applicant's ailment in the sense that it is written
appp.911.18 2/2 that this applicant is suffering from "illegible/illegible/ non-progression of labour".
The learned Counsel for the applicant is unable to explain the meaning of the illegible words and also unable to explain as to how a patient would suffer from "non-progression of labour". Effectively, this would mean that the Certificate relied upon by the applicant really does not substantiate her case in full sense. Nevertheless, considering the fact that the applicant has just delivered a baby, further one month's time can be granted to her to comply with the order passed by this Court on 09/03/2018. Accordingly, this application is partly allowed and further one month's time from 7th June, 2018 is granted to the applicant for complying with the order passed by this Court while granting her temporary bail.
The applicant is directed to surrender herself before the trial Court on 6th of July, 2018.
