Pursuant to the order passed by this Court on 05.12.2018, the learned Assistant Government Pleader has tendered a pursis along with the reports of the Resident Deputy Collector, Tahsildar Lakhani and Talathi Pendhari, Taluka Lakhani on the competency of the appellant to prefer this appeal as an Indigent Person.

Seen the aforesaid reports. Same are accepted on record as they are not objected to by any of the parties. The Registry is directed to accept the filing of the appeal as the one filed under Order XLIV Rule 1 of the Code of Civil Procedure, 1908.

The miscellaneous civil application is disposed of. FIRST APPEAL ST. NO. 12090/2016.

Learned counsel Ms Mohini A. Sharma waives notice of hearing on behalf of respondent no.1.

Learned Assistant Government Pleader Shri A.M. Kadukar waives notice of hearing on behalf of respondent no.2. The appellant is directed to file private paper book within six months from today, failing which the appeal shall stand dismissed without further reference to the Court.
