Heard.
The applicant, apprehending arrest in crime registered against him alongwith co-accused (including two sons of the applicant), has sought pre-arrest bail. The accusations against the applicant are that he was present on the spot when the incident took place and co-accused fled from the spot in the car which was mortgaged by the owner of the car with the present applicant.
The applicant is aged about 60 years and has retired from service of Nagpur Improvement Trust. The applicant has stated that he is not involved in any other crime / offence earlier.
Considering the nature of incident, nature of accusations against the applicant and the facts of the case, the following order is passed:
In the event of arrest in Crime No.451/2015 registered by the non-applicant, the applicant be released
2 aba390.17 on bail on furnishing cash security of Rs.50,000/- (Fifty Thousand) and one solvent surety in the like amount. The applicant shall stay out of Nagpur district till the conclusion of the trial.
The applicant shall not enter the municipal limits of Nagpur, without seeking prior permission of the Special Court, except for attending the trial. The applicant shall give details of his address where the applicant will reside and his cellphone and he shall attend the police station on being summoned by the investigating agency.
The application is allowed in the above terms. JUDGE Tambaskar.
