JUNE 14, 2017 This is an application for restoration of Criminal Revision No. 130/2016.

Heard Mr. Tekam, the learned counsel for the applicants.

The revision was filed before this Court challenging the judgment and order of conviction passed by the learned Magistrate and confirmed by the learned lower appellate Court for the offence punishable under Section 498A and 324 read with Section 34 of the IPC. On 15.03.2017, this Court had passed an order by which the applicant was directed to remove the office objections and also to file the private paper book. It was made clear that if during the stipulated period the applicant fails to comply the order, this revision will be dismissed automatically.

By the present application, it is pointed out by the learned counsel for the applicant that she could not remove the office objections for the reasons stated in the application.

appr89.17.odt Though the learned A.P.P. vehemently opposed the application, it is necessary that the applicant should get an opportunity to put up her case properly. In that view of the matter, the application is allowed. Criminal Revision No.130/2016 is restored to the file along with all the earlier orders.

The learned counsel for the applicant submits that the paper book is ready and he will be filing the same within one week.
