In the present writ petition, the challenge is to the judgment and award dated 31.1.2014 in Reference (IDA) Case No.23/2009 decided by the Labour Court, Nagpur. 2.
During the pendency of the present writ petition, the parties amicably settled the matter out of the court and filed the compromise petition/pursis on record.

The perusal of the compromise petition/pursis shows that the same is duly signed by the petitioner as well as respondent no.1. Both the parties are present before this court and identified by their respective counsels. On query made by this court, the respondent no.1 states that she has willingly put signature and understood the contents of the compromise petition and before this court the cheque amount of Rs.3,50,000/- was handed over to her by petitioner. Hence, in my opinion, there is no impediment to accept this compromise petition/pursis in the matter.

The impugned judgment and award dated 31.1.2014 passed by the Labour Court, Nagpur in Reference (IDA) Case No.23/2009 is accordingly modified in terms of the conditions (a) to (h) of the compromise petition. The decree be drawn accordingly.

In view of above, the petitioner-institute is permitted to withdraw the amount of Rs.86,969/- deposited by them before the Labour Court, Nagpur with interest accrued thereon. 6.
