The petitioner has come up with grievance that he is illegally disqualified by the respondents, for non-compliance of non essential conditions as per Clause Nos.26 and 27 of the tender notice. As per Clause Nos.26 and 27, the petitioner was required to submit registration copy, Vat, Vat clearance, IT return, PTE, PTEC with NOC, self affidavit on Rs.100/- stamp paper and GST certificate. It is not disputed that the petitioner has not submitted any of these documents even at the time opening of the bid. There is no explanation on the part of the petitioner for this laxity. According to the petitioner and the respondents, after disqualification of the petitioner there is no bidder and if the respondents want to get the work done, they have to issue fresh tender notice.

As we find that the petitioner has not

2 wp3046.18 submitted the documents as required by Clause Nos.26 and 27 of the tender notice, we are not inclined to exercise the extraordinary writ jurisdiction in favour of the petitioner. The writ petition is dismissed. No costs.
