The applicant is apprehending arrest in Crime 687/2017 registered with Hudkeshwar Police Station, Nagpur for offence punishable under Section 370 of the Indian Penal Code and Sections 3, 4, 5 and 7 of the Immoral Traffic Prevention Act.

The case of the prosecution is that co-accused Mohini and Ashwini were apprehended from an apartment located at Besa Road, Nagpur indulging in immoral activities. The third accused is one Pramila Pohad who is the owner of the apartment in which the immoral activities were going on. The applicant is arrayed as accused 4 in the charge-sheet and the accusation is that he is used to arrange the women for the prostitution business.

Perusal of the charge-sheet reveals and the learned Additional Public Prosecutor Shri S.S. Doifode also fairly states, that the only material against the applicant is the statement of the co-accused. In this view of the matter, the application shall have to be allowed. 5.

The application is allowed.

The interim order dated 29-5-2018 is confirmed with the modification that the applicant shall attend Hudkeshwar Police Station, Nagpur as and when so called by the Investigating Officer.
