By this writ petition, the petitioner challenges the order of the Senior Regional Manager of the respondent-HPCL dated 22/01/2015, rejecting the application filed by the petitioner for cancellation of the selection of Mrs. Meena Raut for L.P.G. Distributorship from Ganeshpur, Bhandara.

Shri Meghe, the learned counsel for the respondentHPCL, states on instructions and on the basis of the affidavit-inreply filed on behalf of the respondent that the selection of Sou.Meena Raut, who is not joined as a party to the petition is now set aside and the respondent is reconsidering the eligibility of the candidates on the basis of the lease deed in view of the judgment in a writ petition. It is stated that the eligibility of the candidates would be reconsidered on the basis of the lease deeds and then a fresh draw would be conducted.

In view of the statement made on behalf of the respondent-Corporation, the learned counsel for the petitioner states that the grievance of the petitioner would not survive. It is stated that the petitioner would file appropriate proceedings, if a cause of action arises, in future.

wp3856.15 2/2 In view of the statements recorded herein above, we dispose of the writ petition with no order as to costs. The points raised in the petition are, however, kept open. JUDGE JUDGE KHUNTE
