This is an application for condonation of delay in filing criminal appeal.

Heard Shri R.M. Daga, learned counsel for the applicant.

The applicant stands convicted in Sessions Trial No. 16 of 2018 for the offence punishable under Section 302 of the Indian Penal Code vide judgment and order of conviction passed by learned Additional Sessions Judge, Chandrapur dated 17.03.2021. The applicant is directed to suffer life imprisonment and presently he is in jail.

Shri Daga, learned counsel for the applicant submits that there is a delay of 99 days.

We have also heard Shri V.A. Thakare, learned Additional Public Prosecutor for the non-applicant/State. Though this application is coming for the first time we see no
4 appa 486.2021 reasons to keep it pending and it can be disposed of at this stage.

Since the applicant is in jail and he is challenging the judgment and order of conviction, we allow this application. The delay in filing of criminal appeal stands condoned.

Registry is directed registered the criminal appeal. 7.
The criminal application is disposed of.
