In a suit which is pending for more than ten years the petitioner/plaintiff sought temporary injunction which prayer is informed to be not decided which otherwise should have been decided within thirty days of such application as per the mandate provided under Order XXXIX of the Code of Civil Procedure, 1908.

It is brought to our notice by Shri S. S. Sharma, learned counsel for the petitioner that the suit is presently transferred on the file of 7th Jt.Civil Judge (Senior Division).

In view of the grievance made, we deem it appropriate to request the said Court to decide the application for temporary injunction expeditiously and in any case within a period of four weeks from the date of conclusion of hearing. Let hearing be concluded within a period of three weeks from today. 4.

We permit the petitioner to produce copy of this order before the Court below as we are informed that the hearing is scheduled on 08/07/2024.

Order accordingly.

In view of above, the writ petition is disposed of as not pressed. No costs.
