DATE : July 26, 2017 By this application, it is prayed that the compromise arrived at between the parties be recorded on the basis of which the appeal can be disposed of. The suit as filed was for partition and separate possession of 1/5th share of the plaintiff. The trial Court dismissed the suit. The appellate Court however,passed a decree and granted 1/5th share to the plaintiff. During pendency of the appeal the parties have arrived at a compromise as to the manner in which the shares in the property are to be enjoyed. The parties are present in Court today. Their learned counsel have identified them. The application is also signed by the parties through

ca1015 2/2 their power of attorney holder.

Considering contents of the compromise as agreed which appear to be reasonable and are acceptable to the parties, the Second Appeal can be disposed of in those terms.

The judgment of the Appellate Court in Regular Civil Appeal No. 85/2007 dated 24/4/2014 is partly modified in terms of compromise as recorded in this application. The Second Appeal is disposed of in those terms. Decree be drawn accordingly. No costs. JUDGE nandurkar
