By this application, applicant/appellant No.2 is seeking direction for renewal of passport. 2.

It is submitted that the applicant is a citizen of Nagpur district and having clean antecedents. 3.

The passport issued to the present applicant is already expired and his children are residing at abroad and he requires to visit there at various occasions, and therefore, passport authorities be directed to renew or reissue the passport of the applicant for usual period of 10 years.

Learned APP strongly opposed the application on the ground that the applicant is already convicted of the offence punishable under Sections 406 and 420 read with Section 34 of the Indian Penal Code. In view of that, the application deserves to be rejected.

Though the applicant is convicted under Sections 406 and 420 read with Section 34 of the IPC but his appeal is pending before this Court.

Learned Counsel for the applicant placed reliance on the Sangram Ashok Swami Vs. Regional Passport Office, Pune and ors. [2024 ALL MR (Cri) 1664] wherein it is directed that the passport authorities shall issue the passport or renew the passport of the applicant for usual period of 10 years.

Considering the fact that though applicant is convicted but the passport was already issued in his favour which is expired, and therefore, it is necessary to renew the same.

In view of that, the passport authority is directed to renew/reissue the passport of the applicant for usual period of 10 years.

The application is disposed of.
