This is a successive application after withdrawal of the first application on disclosing by this Court that the Court was not inclined to grant bail. Thus, once the earlier application was not considered by this Court on merit, the successive application can be entertained only on the ground of change in circumstances.

In the present matter, it is the case of the applicant that there is no progress in the trial and therefore, there is change in the circumstances and further the ornaments, which were seized and recovered from the accused have not been deposited with the trial Court despite repeated requests by the applicant.

I do not find both the above grounds as change in circumstances entitling the applicant to apply for grant of bail.

Accordingly, the application is rejected.
