The only prayer made by the petitioner in the instant petition is for a direction against the respondents to grant permission to the petitioner-society to transfer the hostel at Paoni, where the school is permitted to be transferred. Shri Balpande, the learned Assistant Government Pleader appearing for the respondent no.1, states that before seeking the permission of the State Government, it would be necessary for the petitioner-society to seek the permission of the Chief Executive Officer, Zilla Parishad, Bhandara.

Shri Thakare, the learned counsel for the petitioner, states that the petitioner would seek the permission of the Chief Executive Officer of the Zilla Parishad and this Court may direct the Chief Executive Officer of the Zilla Parishad, Bhandara to decide the proposal of the petitioner within a time frame. Since the prayer made by the petitioner is innocuous, we dispose of the writ petition with a direction against the Chief Executive Officer, Zilla Parishad, Bhandara to consider recommending the application of the petitioner for permission to transfer the hostel to Paoni, if made within two months and with

2 wp3689.16.odt a direction against the State Government to decide the proposal for transfer of the hostel to Paoni within two months from the date of receipt of the same from either the petitioner or the Chief Executive Officer, Zilla Parishad, Bhandara. Order accordingly. No costs.
