DATE : 26.02.2016 By this petition, the petitioners have challenged the impugned order transferring the assessment case of the petitioners from Nagpur to Jodhpur as being arbitrary and unconstitutional.

It appears on a reading of the Pursis St. No.8233/2004 that during the pendency of the writ petition, the impugned order dated 25.4.2003 was withdrawn by the respondent and fresh order was passed on 28.1.2004, which is under challenge in Writ Petition No.1455/2004. In view of the statement made in the Pursis, the cause for filing the writ petition has been rendered infructuous. The writ petition is disposed of with no order as to costs. Rule stands discharged.
