It is stated that respondent Nos.2 and 3 do not have any funds to go on with tender process and, therefore, they are now seeking permission of the Court to cancel the tender under challenge. Considering the reason put-forward by respondent Nos.2 and 3, this Court would not say anything more and learned counsel for the petitioner also agrees that this petition has been rendered infructuous. It is disposed of accordingly. No costs.

If respondent Nos.2 and 3 have received any EMD amounts, they be refunded to the bidders forthwith including the petitioner and respondent No.4 with applicable interest.
