Heard learned counsel for the parties for some time.

Learned Assistant Government Pleader Shri N.R. Patil for respondent Nos.1 to 3 is again seeking an adjournment to clarify the confusion. The petitioner is claiming employment on compassionate ground.

We, therefore, find that the interests of justice can be met with by directing the petitioner to appear before respondent No.3-Education Officer (Secondary) on 29.8.2016. Respondent No.3 shall hear the petitioner, respondent Nos.4 and 5 peruse the records and find out whether any vacancy exists for accommodating the petitioner on compassionate .....2/-

ground. If such vacancy is available, the petitioner shall be given appointment order, as per law against that vacancy.

While considering this aspect, the Education Officer (Secondary) shall keep in mind that the application moved by the petitioner is dated 6.6.2012 and his father has expired while on employment on 15.5.2012. This exercise shall be completed within next three months.

With these directions and keeping all rival contentions open, we dispose of the petition. No costs. JUDGE JUDGE !! BRW !!
