Applicant is arrested on 23rd January, 2017 in connection with Crime No.15/2017 registered against him, his mother, his father and his sister for the offence punishable under Sections 304-B, 498-A read with Section 34 of the Indian Penal Code on the accusations that because of constant harassment and demand the wife of applicant has committed suicide.

The application is opposed on the ground that the incident has occurred within two years of marriage at the matrimonial house of deceased. It is submitted by the learned A.P.P. that the evidence collected by the investigating agency supports the claim of prosecution.

The investigation is complete and charge-sheet is filed on 19th April, 2017. The

2 ba517.17 non-applicant has not been able to point out that further custody of applicant is required for investigation. The learned Advocate for the applicant has submitted that co-accused Latabai and Puja are released on bail as per the order passed by this Court. The applicant, aged about 30 years, claims that he had been in service with the Indian Railways and is not involved in any other crime / offence.

Considering the facts of the case, following order is passed:

The applicant having been arrested in connection with Crime No.15/2017 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.50,000/- (Rs. Fifty Thousand) and furnishing one solvent surety in the like amount. The applicant shall attend the sessions trial regularly on every date unless granted exemption by the Sessions Court.

The application is allowed in the above terms.
