By the present applications, the applicant prays for setting aside abatement, condonation of delay and bringing the Legal Representatives of Respondent No.1 on record. Though there is a delay of 895 days, the learned counsel appearing on behalf of the legal representatives of respondent no.1, has no objection if the applications are allowed, since the LRs are interested in proceeding with the matter on merit.

In view of the above and for the reasons set out in the respective applications, all the three Applications are allowed as prayed for. Necessary amendment be carried out within one week from today and amended copy be served upon the other side. 4.

Both the Advocates are ad-idem that there is an element of settlement and accordingly made a request to refer the matter for mediation.
