Affidavits filed by the deponent i.e. Director of the applicant/Company are taken on record.

All these applications are filed by the respondent/applicant in the present criminal revisions applications for seeking permission of the withdrawal of the amount which is deposited by the applicant in this Court as well as before the Court of Additional Sessions Judge-12,

All the revisions applications filed are challenging the order of conviction passed by learned Judicial Magistrate First Class and confirmed by the Revisional Court i.e. Additional Sessions Judge-12, Nagpur. During the pendency of these revisions, the matters were referred to the Mediator for mediation, which were settled. Learned counsel for the applicant submitted that he has already complied with the terms and conditions of the settlement and he has also furnished the affidavit of the compliance. Learned counsel for the respondent submitted that as the matter is amicably settled between the parties and the amount are lying in this Court as well as before the Court of Additional Sessions Judge-12, Nagpur therefore, he be permitted to withdraw the said amount.

In view of settlement, the respondent is permitted to withdraw the amount on due identification and verification before the office. The respondent shall file appropriate application for withdrawal of the amount which is deposited in the Court of Additional Sessions Judge-12, Nagpur and learned Sessions Judge shall consider the application and pass appropriate orders permitting to withdraw the amount to the respondent.

All the applications are disposed of.

The respondent be permitted to withdraw the amount in view of settlement along with accrued interest thereon.

All the revisions applications being amicably settled between the parties, are disposed of.

In view of the settlement between the parties, the applicant is acquitted from the offence punishable under Section 138 of the Negotiable Instruments Act. ( URMILA JOSHI-PHALKE , J.) Gohane
