In both these matters, we have heard Mr.Ashok Mundargi, learned Senior Advocate assisted by Mr.A.A.Naik, learned Counsel and Mr.S.P.Dharmadhikari, learned Senior Advocate assisted by Mr.Rohit Joshi, learned Counsel for the respective petitioners. Permission is sought to withdraw both these petitions with liberty to approach the trial Court for discharge, leaving all
Order 162wp482.17 points open to be agitated in such applications. It is pointed out to us that the offences against the petitioners were registered on 30.4.2017; but, till this date, none of the petitioners is arrested. Learned Senior Advocates submit that the petitioners would co-operate in the investigation & shall periodically visit the concerned Police Station & after filing of charge sheet, they would appear and apply for regular bail.
In view of above, both the petitions are permitted to be withdrawn with liberty, as prayed for.
No coercive action shall be taken against the petitioners till filing of the charge sheet. The petitioners shall co-operate in the investigation and shall visit the concerned Police Station once in every fifteen days, apart from the dates on which they shall be called, failing which, the respondents shall be at liberty to proceed with the coercive action.
