The present application is filed for transfer of proceedings in HMP No. 494/2022 pending on the file of learned Civil Judge, Senior Division, Nagpur to learned Civil Judge, Senior Division, Amravati. The applicant is residing at Morshi, District Amravati. 2.

In spite of granting ample opportunity, none for the respondent.

It is submitted that the applicant is legally wedded wife of the respondent. Their marriage was performed on 03/05/2006. They have one son named Arnav, aged about 16 years and one daughter named Shrushti, aged about 13 years. Due to harassment to the applicant at her matrimonial house so also the applicant and her children were left by the respondent, the applicant was constrained to leave her matrimonial house. The respondent is not paying maintenance to the applicant and her children. 4.

The distance between Nagpur to Morshi is about 200 Km. and as such, it is inconvenient for the applicant to attend the

31-MCA 614-2023.odt proceeding at Nagpur. There is no reply filed by the respondent. Considering the inconvenience and hardship which is going to cause to the applicant to attend the proceedings at Nagpur, I proceed to pass the following order:- O RDER

1) The proceedings in HMP No. 494/2022 pending before learned Civil Judge, Senior Division, Nagpur is hereby withdrawn and transferred to learned Civil Judge, Senior Division, Amravati.

2) The learned Principal District and Sessions Judge, Nagpur is hereby requested to facilitate the said transfer.

3) Accordingly, the application stands disposed of. (Smt. M.S. Jawalkar, J.) B.T.Khapekar
