Considering the explanation given by the respondent No.1 in the affidavit sworn by him on 14th December, 2017 and accepting the undertaking given by the respondent No.1 that he will co-operate in disposal of the civil suit as per the directions given by this Court, I do not think it appropriate to initiate the proceedings under the Contempt of Courts Act, 1971 against the respondent.

The notice issued to the respondent No.1 is discharged. The contempt petition is disposed. In the circumstances, the parties to bear their own costs. JUDGE RRaut..
