Shri Marpakwar, learned counsel for the petitioner makes a statement that respondent no.1 has already raised claim before the Resolution Professional appointed by the NCLT, Mumbai. This Court in Writ Petition No.2846/2020, while considering such a position has passed an order dated 24/8/2022, considering which, the petition is dismissed and it would be permissible for the Resolution Professional to decide the claim of the respondent No.1 since it is raised before him.
