Rule. Rule made returnable forthwith and heard learned counsel for the parties.

The petitioner who is serving as an Assistant Professor in Physics with the respondent No.4-College claims benefit admissible as per recommendations of the 6th and 7th Pay Commission. It is prayed that such arrears for the period from 01/04/2015 to 28/03/2017 be paid to the petitioner. Attention is invited to the judgment passed by this Court in Writ Petition No.4619/2018 (Dr Rajesh Kumar Das s/o Subhashchandra Das vs. The State of Maharashtra, Dept. of Higher and Technical Education and ors.) with connected matter

10-WP-4585-19 2/2 dated 19/03/2019. It is submitted that these writ petitions pertain to similarly situated teaching staff members of the same college. On this basis it is submitted that similar directions be issued in this writ petition.

Shri K. S. Malokar, learned counsel for the respondent Nos.3 and 4 submits that on 28/08/2021 the pay bills towards the aforesaid arrears have been forwarded to the Joint Director of Higher Education, Amravati Division, Amravati. This fact is admitted by the learned Assistant Government Pleader for respondent Nos.1 and 2.

In view of aforesaid the respondent No.2 shall take necessary steps in the matter within a period of three weeks from receiving copy of this order and after examining the entitlement of the petitioner, release the amount of arrears if the petitioner is found so entitled.

With these directions the writ petition is disposed of. Rule accordingly. No costs.
