Heard Shri R.S. Sundaram, learned counsel for the petitioner and Ms. M.S. Rane, learned AGP the respondent No. 2, for sometime.

Shri Sundaram, learned counsel points out that in case of one P.B. Mistri, (Controller of Examinations), in identical circumstances, after withdrawal of charge sheet, all benefits have been released. He states that in present matter also, the petitioner should be given same treatment. The learned AGP states that this grievance does not figure in present petition and the challenge is to the validity of Rule 39(1)(v) of Standard Code of Nagpur University.

Nobody appears for Respondent No. 1 - Nagpur University.

Shri Sundaram, learned counsel, upon instructions states that these are subsequent developments. In view of subsequent developments and as nobody appears for Respondent No. 1 - Nagpur University, we grant the petitioner leave to make appropriate

0305wp2160.05 representation to Respondent No. 1. If such a representation is made within four weeks from today, Respondent No. 1 shall independently look into it within next eight weeks.

Keeping all rival contentions open and with these directions, we dispose of the present writ petition. Rule made absolute accordingly. No order as to costs. JUDGE JUDGE *GS.
