Present application is filed by the applicantappellant for condonation of delay in preferring the first appeal. The delay is of 23 days.

For the reasons mentioned in paras 2 to 6 in the application, I am satisfied that there is no intentional or deliberate delay in filing the first appeal. There are justified reasons to condone the delay. As such, application is allowed. Delay in filing first appeal is hereby condoned. Registry is directed to register the first appeal.

After registration of first appeal, issue notice to the respondents, returnable within three weeks.
