The applicant is arrested on 3rd February, 2017 in crime registered against him for the offences punishable under Sections 498-A, 306, 304(B) of the Indian Penal Code on the accusations that because of ill-treatment meted out by him to his wife she has committed suicide by pouring kerosene on her person. The application is opposed on the ground that the incident has occurred within one year of the marriage and at the matrimonial house.

The applicant, aged about 31 years, claims to be labourer, which fact is not controverted by the non-applicant. The investigation is complete and charge-sheet is filed on 29th April, 2017. The non-applicant has not been able to point out that custody of the applicant is required for further investigation.

Considering the facts of the case, I am of the view that the applicant is entitled to be released on bail.

2 ba520.17 Hence, the following order:

The applicant having been arrested in Crime No.20 of 2017, registered by the non-applicant, he be released on bail on furnishing P.R. Bond for Rs. Fifty Thousand with two solvent sureties in the like amount. The applicant shall attend the trial before the Sessions Court on every date unless granted exemption by the Sessions Court.
