Shukre, J Dated : October 19, 2016 Learned counsel for the applicant submits that right from beginning the applicant is present in the Court and thus, he has submitted to the jurisdiction of this Court. This submission is put forth for the first time and it was never disclosed in the past and that the applicant was present before the Court and surrendering himself to the jurisdiction of this Court.
Learned APP submits that on the last date, it was informed by learned counsel for the applicant to him that the applicant was present in the Court, but it was never disclosed to him that the applicant was making attempt to submit to the jurisdiction of this Court.
Now, the applicant is present in the Court and voluntarily submits, as conveyed on instructions by his counsel, that he is surrendering to the jurisdiction of this Court. Surrender is accepted. He is, however, released on temporary bail on his executing PR Bond of Rs. 25000/- on the condition that he shall appear before the concerned Judicial Magistrate, First Class having jurisdiction in the case on 20th October 2016 at 2.30 pm. Applicant undertakes to file application for grant of regular bail before the trial Court
2 ba521.16 tomorrow itself which shall be decided by the learned Magistrate after hearing the prosecution within seven days thereafter. Interim bail granted to the applicant shall remain valid till his regular bail application is decided by the trial Court.
PR Bond be furnished before the Registrar (Judicial) of this Court who shall forward the same to the concerned Magistrate.
Application stands disposed of accordingly.
