The record shows that this matter was listed for admission on 2.7.2018. On the said day, for and on behalf of learned counsel Shri C.N. Wankhede, an adjournment was sought and the said was granted. Thereafter, the matter was fixed on 16.7.2018. On the said day, nobody was present on behalf of the appellant. Therefore, the matter was adjourned to two weeks. 2.

Again, on 30.7.2018, the matter was listed for admission. On the said day also, none appeared for the appellant. 3.

Today, in the morning session when the matter was called out, neither the appellant nor his counsel was present and the matter was kept in second half. In second half also, when the matter is called out, nor the appellant nor his counsel is present nor there is any request for adjournment on the part of the appellant.

The chronology of the aforesaid events shows that the appellant and his counsel are not interested in prosecuting the appeal. Hence, the first appeal is dismissed for want of prosecution. JUDGE !! BRW !!
