By this Application, the applicant has prayed for condonation of delay in preferring the instant Appeal.

According to the applicant, his wife being illiterate, was not knowing about the legal remedy available to the applicant. Considering the fact that the applicant is in jail and since the delay is not intentional and deliberate, the delay of 46 days in filing the instant Appeal is hereby condoned, subject to payment of costs of Rs. 500/- to the legal Aid Services Sub-Committee Nagpur within a period of four weeks form today. Criminal Application is allowed accordingly.
