IN THE COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO. 4518/2016 ( Shri Laxman Budhamal Angnani vs. The State of Maharashtra and others ) .............................................................................................................................................. Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's order of directions and Registrar's orders .............................................................................................................................................. Mr. S. G.Joshi, Advocate for the petitioner Mr. Nitin Rode, A.G.P. for Respondent Nos. 1 to 3 CORAM : B.P. DHARMADHIKARI & MRS. SWAPNA JOSHI, JJ.

DATED : 12th January, 2017 Heard respective counsel.

Respondents have forwarded proposal to State Government for its approval and if it is approved alternate land shall be made available to petitioner. In that event, the petitioner can hand over possession of site to be acquired from him, for the purposes of road widening.

We find that this acquisition is going on since 2004. Thus, for about 12-years the work of road widening has not taken place. In this situation, we direct respondent no.1 to take appropriate decision on proposal received by it within six weeks from today. If the respondents decide to allot alternate land to petitioner, the possession of site to be acquired from petitioner shall be handed over to respondents.

The Writ Petition is, thus, partly allowed and disposed of. JUDGE JUDGE sahare
